Terms of service
1. SCOPE
1.1. These General Terms and Conditions (GTC) apply to all contracts for the purchase of goods that you conclude with us, phc skincare GmbH, Kaiserswerther Straße 132, 40474 Düsseldorf, via our online shop.
1.2. Pre-formulated conditions provided by you that deviate from these GTC shall not become part of the contract, even if we are aware of them, unless we expressly agree to their validity in text form (e.g. by email).
1.3. The GTC apply only if you are a consumer, meaning the purpose of the ordered products and services cannot predominantly be attributed to your commercial or self-employed professional activity.
1.4. Any sale to customers acting in the course of their commercial or self-employed professional activity, and therefore as entrepreneurs, or any sale of quantities exceeding normal household volume, must be notified to us separately in advance.
1.5. The contract language is German.
2. CONCLUSION OF CONTRACT
2.1 Our product and price information provided during the ordering process is non-binding and subject to change.
2.2 You may first place products in the virtual shopping cart without obligation. After clicking the “Proceed to Checkout” button, you can enter your shipping and billing information and select your preferred payment method. You may correct your entries at any time before submitting your binding order using the correction tools provided in the ordering process. By clicking the “Buy Now” button, you submit a binding order for the products in your cart. Confirmation of receipt of your order is sent immediately by email after submitting the order.
2.3 The time at which the contract is concluded depends on the payment method you choose:

Klarna Invoice and Instalments
We accept your order by sending a separate acceptance email or by shipping the goods within two working days. -
Klarna Instant Transfer
After placing your order, you will be redirected to the website of the payment service provider Klarna Bank AB (publ). The contract is concluded when you trigger the payment instruction there. -
Credit Card
By submitting your order, you transmit your credit card details to us at the same time. After verifying your identity as the legitimate cardholder, we request your credit card company to initiate the payment transaction and thereby accept your offer. -
PayPal
After completing the order, you will be redirected to the PayPal website. There, you can trigger the payment instruction to PayPal. By requesting the payment transaction from PayPal, we accept your offer. -
Advance Payment (Bank Transfer)
We accept your order by sending a separate acceptance email within two days.
2.4 We do not store the contract text.
2.5 Beauty Subscription: By clicking “Buy,” I confirm that I am purchasing a subscription involving recurring payments. The ongoing delivery of the purchased product depends on my subscription payments. I have taken note of the amount and frequency in the order overview on this page. Unless cancelled, the subscription continues. The subscription may be cancelled at any time after a minimum term of 4 deliveries.
3. PRICES AND PAYMENT METHODS
3.1 All prices include the applicable statutory VAT and are subject to a shipping fee.
3.2 The following payment methods are generally available for deliveries:
In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer the following payment options. Payment is made directly to Klarna:

Invoice: The payment period is 7 days from shipment of the goods or, in the case of other services, from provision of the service. Full invoice terms for countries where this payment method is available can be found here: Germany, Austria, Switzerland.
Instalment Plan: With Klarna’s financing service, you can pay your purchase in fixed or flexible monthly instalments according to the terms displayed at checkout. Instalments are due at the end of each month after Klarna issues a monthly invoice. Further information regarding instalment plans, including terms and European Standard Consumer Credit Information, can be found here (availability depends on country): Germany, Austria. - Instant Transfer: Available in Germany and Austria. Your account will be charged immediately after placing the order.
- Credit Check: The use of invoice, instalment purchase, and direct debit requires a positive credit check. To this end, we forward your data to Klarna for address and credit verification. Based on the credit check results, we can only offer payment methods permitted by Klarna. Further information and Klarna’s terms of use can be found here. General information is available at Klarna. 3.3 Unless otherwise stated for a specific payment method, payment is due immediately after the contract is concluded.
4. DELIVERY AND SHIPPING CONDITIONS
4.1 Delivery of the products is carried out by shipping to the delivery address you provide.
4.2 You will be informed of delivery times and delivery restrictions (e.g., limited delivery to certain countries) for individual products on a separate information page “Shipping Costs & Delivery Times” or in the respective product description.
4.3 Any customs duties or local taxes must be borne by you.
5. RETENTION OF TITLE
The delivered product remains our property until full payment has been made.
6. RETURNS
6.1 Returns are possible within 14 days after purchase for unopened products.
6.2 Returns must be arranged independently and at your own cost.
6.3 Gifts or free items included in the order must also be returned; otherwise, they will be charged at the recommended retail price.
7. NO SALES TO COMMERCIAL BUYERS
7.1 The products offered on our shop are sold exclusively to consumers. Commercial resale of the products is not permitted without our explicit consent.
7.2 We reserve the right to withdraw from the purchase contract if a customer purchases products with the intention to resell them or has already resold them in violation of paragraph 1.
7.3 We reserve the right to assert claims for damages resulting from unauthorized resale of our products.
8. WARRANTY
8.1 In the event of defects in the delivered goods, you are entitled to statutory warranty rights, independent of any guarantee.
8.2 If guarantees are advertised, the details can be found in the guarantee conditions, which are made available in text form before you complete your order.
9. COPYRIGHT AND IMAGE RIGHTS
All copyright and image rights displayed on the website belong to us or we are authorized to use them. Any use without our explicit consent is prohibited.
10. SMS
By agreeing to SMS marketing from phc skincare GmbH and providing your mobile number during checkout, you consent to receiving recurring text notifications (for your order, including abandoned cart reminders), text marketing offers, and transactional messages, including review requests—even if your number is registered on any state or federal Do-Not-Call list. Message frequency varies. Consent is not a condition for purchase.
To unsubscribe from marketing text messages, reply STOP to any message or use the unsubscribe link provided in one of our messages. You understand and agree that alternative methods of opting out (such as different wording) will not be considered valid. We do not charge for the service, but you are responsible for any SMS or data fees charged by your carrier. Message and data rates may apply.
If you need help, text HELP to the number from which you received the messages. You may also email our support team at support@phc-beauty.com.
We reserve the right to change any phone number or short code we use for the service at any time. In such cases, you will be notified. Messages you send to a changed number—including STOP or HELP—may not be received, and we cannot be held responsible for not responding to such messages.
To the extent permitted by law, you agree that we are not liable for failed, delayed, or misdirected delivery of information sent through the service.

11. INFORMATION ON ALTERNATIVE DISPUTE RESOLUTION
The EU Commission offers a platform for online dispute resolution at http://ec.europa.eu/consumers/odr/.
We also point out, in accordance with § 36 (1) and (2) of the German Consumer Dispute Resolution Act, that we are neither willing nor obliged to participate in a dispute resolution procedure before a consumer arbitration board.
12. FINAL PROVISIONS, CHOICE OF LAW
12.1 German law applies, excluding the provisions of the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the country in which they have their habitual residence.
12.2 Should individual provisions be wholly or partially legally invalid or unenforceable, or lose their legal validity at a later time, the validity of the remaining provisions shall not be affected. Instead of the invalid or unenforceable provisions, the statutory provision applies.
